This is an Spanish Ape. I bought my first XXX shared with Etoro before finding out that they allow NO transfer thous no possibility to DRS.
I received a surprising phone call from my Etoro's "Personal Advisor". He wanted to know how happy I was about Etoro. I was quite polite but told him all things you already know. Now is when things become really interesting. He told me, and this is a personal translation and not the exact words but mostly the exact meaning:
"Would you change your mind about us if I would tell you that we are working to change several things like, for example, allowing transfer, because WE, AS A BROKER, NEED TO ALLOW TRANSFER IN ORDER TO COMPLY WITH USA LAW".
And I was like: " The Fuuuck?!"
The thing is that I've been trying to find out if this is true or if he was just trying to keep me "happy".
I've found lots of related info but nothing conclusive. English is not my mother language and my lack of knowledge In this field doesn't help. Everything sounds a mess to me: Private or Public company, Board, Retailer, Broker, .....
So,.is there any Ape out there with deep knowledge in this topic that could possibly confirm or debunk this?
If it would be true that Etoro, to comply with USA laws, must allow transfer, that would be Great News and we, customers, could add lots of pressure on them.

Micheal: The builder community are very collaborative. We are going to see incredible and powerful defi that is not possible elsewhere. In terms of NFTs it a great platform for NFTs what does a NFT defi integration look like?
Adrain (AJ): Bring Meld gold to defi working with poly capital to allow gold to earn gold, which has global implications, all treasuries hold gold. The storage and insurance cost to flip that to earn rather than cost is a great benefit
Jeff: Japan early to embrace blockchain 1st to regulate crypto assets. Gov and business support blockchain since very early. There is a path to DeFi, digital payments are coming. Micheal: Defi must be global. Translations are important. Global partners are important. Algopluse is offering translation services.

Etoro's terms of service and MOASS
This is the first time I'm posting something like this, I thought this was important because if my understanding is correct this could stop etoro apes from selling during the MOASS, if my interpretation is wrong and I'm unknowingly spreading FUD please let me know. ( there's a TL:DR at the bottom, but as I mentioned if I'm wrong please let me know so I can either delete or correct the post)
I saw a couple of posts about etoro, how they limited voting, still won't allow DRS and the overall impression I got was that they are not like "conventional" brokers, not that I have a load of experience with trading, etoro was my first exposure to trading apart from a trading212 mock account, but what I read made me worry about the possibility of them pulling a Robin hood and blocking trading.
So I checked their U.K TOS Ill leave the points in question and the aspects I believe could stop the MOASS for apes with etoro accounts.
I'll start with the seemingly most obvious one and highlight in bold what I found worrying.
26.Closing or blocking access to your eToro account and/or Services 26.1 You can close your eToro account at any time by sending us an email. Your eToro account will be closed within the seven days after we receive your email. You may also close your eToro account via the settings section of our platform. 26.2 We will execute as well as close (as applicable) any orders which you have placed before requesting to close your account in accordance with clause 26.1 above. After this one there's also another point regarding entering into transactions, I'm unsure if this works for both buying and selling but regardless it seems obstructive, and something to keep in mind.

Exceptional events they mention this a lot so I started asking myself, wtf they mean by it.

(h) the abandonment or failure of any instrument that we use to make our quotes; (i) excessive changes to the price, supply or demand of any product. We may also call an Exception Event where we anticipate this change (within reason); (j) technical failures in transmission, communication or computer facilities including power failures and electronic or equipment failures;
(k) the failure of any supplier, intermediate broker, agent, principal custodian, sub-custodian, dealer, exchange, clearing house or regulatory organisation to perform its obligations to us; (l) liquidity providers not providing, or being unable to provide liquidity, to us. Liquidity describes the degree to which a product can be quickly bought or sold at a price reflecting its appropriate value; and/or (m) an event which significantly disrupts the market, which could include (but is not limited to) the premature close of trading in the market of a product, excessive movements in the price, supply or demand of a product, whether regulated or unregulated that our Services relate to. 29.2 If an Exceptional Event happens, the availability and speed of our service, including our platform, website, our execution of your order, the availability of the different functionalities which we may provide as part of our Services including instructions which you may give in respect of a trade, as well as any of our obligations under this Agreement may be delayed, may not be available, or may not be carried out.
We will not be liable to you for any losses which you incur as a result. If we think, in our reasonable opinion, that an Exceptional Event has occurred or is occurring, we may make the following changes to your eToro account without telling you: (a) change your margin requirements which might mean that you may have to provide more margin (we explain what margin is in Schedule A – Trading CFDs); (b) limit the availability of instructions that you can give in respect of an order or trade;
(c) close your open transactions at a price that we reasonably think is proportionate; (d) change the trading hours for a product; and (e) cancel all open orders or trades which are affected by the exceptional event. However reading through the terms and conditions of the FSCS it seems the £85000 are only payable if its etoro that defaults. This means that unless etoro defaults they can block us from selling and we'll get jack shit.

If we assume etoro is the provider, and consider the TOS, it all seems to indicate that in case that Exceptional event they refer to happens (MOASS), they can block trading and we will only be paid if etoro(the provider) defaults. If they don't, they can just turn off the sell button a la Robinhood, keep the money and we get only what they deem fair or worse case scenario, nothing.
Not sure how the €20000 are payable if you're in the EU I didn't delve into that one, but there's already enough on the TOS to make me want to move away from etoro ASAP.
Regardless, £85000 and €20000? Behave.

Cyprus E-money service regulation Act: application on blockchain and virtual money
 | The Cyprus government is taking steps to bring some clarity to the vague legal framework of the crypto-assets sector. The regulatory incentives, in line with favourable corporate income tax rate (12.5%) seem to attract more investment into virtual assets business. With this in mind, it is worth discussing if recent developments are enough to meet emerging industry standards. Regulatory measures Country’s primary financial regulator is the Central Bank of Cyprus (hereinafter referred as:-“ CBC”) that supervises and issues licenses for setting up and operation of fintech businesses, including payment and electronic money institutions. The Cyprus Securities and Exchange Commission (hereinafter referred as:-“ CySEC”) administers operations and assures compliance with financial regulations and with the European MiFID financial harmonised law. The Cyprus government has amended main statutory legislation in the industry - Electronic Money Law (2012) and 2018 consistent with the following EU directives: - 2009/110/EC of 16 September 2009 on the taking up, pursuit and prudential supervision of the business of electronic money institutions; and
- (EU) 2015/2366 of 25 November 2015 on payment services in the internal market.
Registration and authorisation procedure Accordingly, the electronic money services can only be carried out with the authorisation of the Central Bank of Cyprus or by remaining EU member states’ competent authorities. The main requirement that has to be met to be granted an authorisation is that an e-money entity must be a legal person incorporated and registered in the Republic of Cyprus with a head office and must conduct part of its e-money service activity and/or provide payment services which are not associated with issuance of electronic money. As per subsections (3) to (8) of section 5 of The Payment Services and Access to Payment Systems Laws of 2018 and 2019 the following documents are needed to apply: - company identification details;
- program of operations;
- business plan;
- structural organization of the business;
- evidence of initial capital (€350.000 for Electronic money issuers);
- description of measures to safeguard funds of users;
- governance arrangements and internal controls;
- procedures for monitoring, handling, and following up on security incidents and security-related customer complaints;
- processes for filing, monitoring, tracking and restricting access to sensitive payment data;
- business continuity measures;
- the principles and definitions applicable to the collection of statistical data on performance, transaction and fraud;
- security policy document;
- internal control schemes to comply with obligations relating to money laundering and terrorist financing**;**
- identity and suitability assessment of persons with qualifying holdings (shareholders) in the applicant
- identity and suitability assessment of directors and persons responsible for the management of the payment institution;
- details of any outsourcing arrangements (auditors);
- professional indemnity insurance or a comparable guarantee for payment initiation services and account information services.
Once the application is filed it takes up to 4 months to receive a decision from CBC. Except institutions Meanwhile, the type entities listed below are exempt from applying to authorization by CBC to carry out electronic money business: - banks licensed by the CBC or by any other EU member state’s competent supervisory authority;
- сooperative credit institutions which have obtained a license from the Authority for the Supervision and Development of Cooperative Societies of Cyprus.
- institutions that provide postal payment services and issue e-money owing to applicable law;
- European Central Bank, National Central Banks when not using their monetary and public powers;
- member states or their regional authorities when not acting in their capacity as public authorities;
- as well as Electronic money institutions authorised to operate by the competent supervisory authorities of other EU member states.
Above mentioned entities have a right to establish or to conduct cross-border e-money business activities on condition that the relevant bodies of their home member state send a notification to the CBC. Anti money laundering measures and crypto asset service providers directive Multiple competent authorities supervise activities related to the money laundering and terrorist financing, such as: Pursuant to section 59(1)(a) of Prevention and Suppression of Money Laundering Activities Laws of 2007 and 2019 (hereinafter:- “ AML law”) the electronic money, payment and currency exchange operators fall under the supervision of the CBC. AML law is the only legal framework which recognizes crypto-assets. pursuant to the law, crypto-assets is ‘a digital representation of value that is not issued or guaranteed by a central bank or a public authority, is not necessarily attached to a legally established currency and does not possess a legal status of currency or money, but is accepted by natural or legal persons as a means of exchange and which can be transferred, stored and traded electronically and is not: - fiat currency; or
- electronic money; or
- a financial instrument that provides for the provision of investment services, the exercise of investment activities, the operation of regulated markets and other related matters.’
Under 61E(1) of the AML Law, on September 13, 2021, CySEC issued Directive 269/2021 which amended earlier ‘Directive for the Prevention and Suppression of Money Laundering and Terrorist Financing (Register of Crypto Asset Service Providers)’ from 25th of June 2021. According to the directive, CySEC establishes statutory requirements for Crypto and Virtual Asset Service Providers (hereinafter referred as:-“ CASPs or VASPs”) to comply and to be featured in the register which maintains in its website. The register is open to public and includes the following data of members: - name, trading name, legal form and registration number (legal entity identifier - ‘'LEI");
- registered physical address;
- official website;
- services offered by the CASPs or VASPs;
The registration is mandatory for the following entities: - CASPs providing or carrying out services or activities from Cyprus, despite their registration status in other EU members states to conduct similar service;
- CASPs providing or carrying out services or activities to Cyprus, except for those entities already holding valid registration from other EU member state’s respective registry to provide services or carry out such activities and services.
So, cryptocurrency service providers who are planning to offer any of the above listed activities must register with CySEC for the purposes of anti money laundering and combating terrorist financing. Application for registration should also contain the following information: - all public addresses of crypto-assets and/or of public keys/digital wallets controlled by the CASP;
- the crypto assets which the CASP operates or provides services for;
- the class of customers the CASP serves;
- details if the CASP is engaged in business payment of crypto assets;
- crypto asset ATMs, number and locations offered by CASP;
- jurisdictions in which CASP operates;
- registrations and licenses owned by CASP.
The official fee for reviewing applications and registration by CySec is €10,000. Upon successful registration, the first annual fee payment will be waived and subsequent yearly fee in the amount of €5,000 applies henceforth. In addition, the fee amount ranging from €1,000 - €5,000 applies to request changes to existing registration, depending on the nature of notification inquired. Moreover, article 14 of the directive mandates CASPs to regularly maintain a minimum equity capital as following: - CASP that provide investment advice - €50.000;
- CASP that provide investment advice as per Category 1 and / or any of below mentioned services - €125.000:
- reception and transmission of client orders;
- execution of orders on behalf of clients;
- exchange between crypto-assets and fiat currency;
- exchange between crypto-assets;
- participation and/or provision of financial services related to the distribution, offering and/or sale of crypto-assets, including the initial offering;
- placement of crypto-assets without firm commitment;
- portfolio management.
- CASP that provides investment advice as per Category 1 or 2 and / or any of the below mentioned services - €150.000:
- administration, transfer of ownership, transfer of site, holding, and/or safekeeping, including custody, of crypto-assets or cryptographic keys or means enabling control over crypto-assets;
- underwriting and/or placement of crypto-assets with firm commitment;
- operation of a multilateral system, which brings together multiple third-party buying and selling interests in crypto-assets in a way that results in a transaction.
However, at the time of writing, CySECs Registry website has not yet been launched and does not seem to be fully operational. Concluding remarks All things considered, Crypto-assets have not yet developed into a distinct identity in the eyes of the law to be regulated as a separate type of economic activity. In the short run, it might not be possible to watch the impact of recent directives on economic activity in the internal market, thanks to the entry restrictions which might restrict new applicants. However, there is a hope that the recently proposed Markets in Crypto Assets Directive is believed to establish a universal framework across the EU and as time passes normalizes the widespread adoption of cryptocurrency across the member states. TLDR; this is a scam, TOS says another website that has been taken down as a scam and their legal certificate is linked to another similar named website but is different.
This is a scam website trying to take 250-300 euro from you. Do not trust them. Here is my evidence against these people.
First of all if you just look at the certificate they have on their website it says reference number (360194) and now if you go to cysec(.)gov(.)cy and search up the reference number it goes to another company Broctagon Prime LTD. Looking at their email it is different from Brocprime(.)net
The real email is:

[email protected] Now there is only small differences you say, and they always have an excuse to why it is different like how it was an old company and they change names and stuff all the time. But if you look at the offical website broprime(.)COM it is still active and if you scroll down on broprime(.)com all the way at the bottom it says "The company's offical website is https://broprime(.)com and we are not affiliated in any way with other domains or companies" This should obviously be huge red flag. As legal documents are supposed to state the official website and a way to contact them.
So this "certificate" they have is wrong and is fraud as they are using another companies name as their own without their consent.
Now into the more nitty gritty if you look at their terms of services it literally says another website in the terms of services so it isn't a very good one. The website we are on is literally brocprime(.)NET and ther TOS says brocprime(.)COM and they will say on the phone that they are not CONNECTED anymore even though on their legal documents it's literally the same website. IF you search up brocprime(.)COM it says the website has been removed on those website trustworthy scanners and on website review sites it says brocprime(.)COM has a 48% ONE star reviews and nobody has even claimed the website as their own. So WHICH goddamn company are you working for??
